Could you walk us through one of the key steps involved in the probate process? Many of our viewers may be unfamiliar with what happens after a loved one passes away.

Certainly. One crucial stage is “Handling Debts and Taxes,” which typically occurs after the estate assets have been marshaled and inventoried. This step involves meticulously reviewing all outstanding debts and obligations of the deceased, such as credit card bills, utility payments, loans, and medical expenses.

Accordingly, we need to identify valid creditor claims and ensure they are paid promptly. Concurrently, we must file and pay any applicable state and federal taxes on behalf of the estate. Ordinarily, this includes income tax returns for the year of death and potentially estate tax returns if the estate exceeds a certain threshold.

It’s crucial to remember that failing to address debts and taxes can lead to significant complications and penalties down the line. Therefore, thoroughness and accuracy are paramount during this stage.

I recall a case where the deceased had accumulated substantial medical debt without adequate insurance coverage. The family was distraught, facing the prospect of losing their inheritance to pay these bills.
