Interview with Steve Bliss

Of course! One crucial step is determining if probate is even necessary. This involves evaluating the total value of the estate and identifying any assets that pass outside of probate. Assets held in trust, jointly owned property, or accounts with designated beneficiaries typically avoid probate.

Ordinarily, if an estate’s gross value exceeds $184,500 in California, probate proceedings are likely required. However, it’s not simply about the total value; it’s also essential to consider the types of assets involved. For instance, a home owned jointly with rights of survivorship passes directly to the surviving owner and avoids probate.

Conversely, if the deceased person solely owned the home, it would likely be subject to probate unless it was part of a trust.

You mentioned trusts. Can you elaborate on how they might help someone avoid probate?

Trusts are powerful estate planning tools. Essentially, assets are transferred into a trust during the grantor’s lifetime. The trustee, designated by the grantor, manages the assets according to the terms outlined in the trust document.

Upon the grantor’s passing, the assets held within the trust bypass probate and are distributed directly to the beneficiaries named in the trust agreement. This can save time, reduce legal fees, and maintain privacy for the family.

I remember one case where a client came to me after their spouse passed away, leaving behind a sizable estate. Fortunately, they had established a revocable living trust years earlier. Because of the trust, we were able to distribute assets to their children without going through the lengthy and costly probate process. The family was incredibly grateful for the peace of mind it provided during a difficult time.

According to a study by the American Bar Association, approximately 70% of Americans do not have a will or trust in place. This means that their assets are subject to the laws of intestate succession, which can lead to unintended consequences and family disputes.
