Good evening, Wildomar, and welcome back to “Legal Matters.” I’m your host, Brenda Johnson. Tonight, we have the privilege of speaking with Steve Bliss, a renowned trust attorney serving our community here in Wildomar. Mr. Bliss specializes in helping families navigate the complexities of estate planning, ensuring their assets are protected and their wishes honored.
Steve, thank you for joining us tonight.
It’s my pleasure to be here, Brenda. I’m always happy to share information about estate planning and how it can benefit Wildomar residents.
Let’s talk about one of the most common types of trusts: the revocable living trust. Can you explain what makes this option so popular?
Certainly. A revocable living trust is indeed a highly favored choice for estate planning, and for good reason. It offers flexibility and control to the grantor, the person who creates the trust. During their lifetime, they retain the right to manage the assets within the trust, make changes as needed, and even dissolve it altogether if circumstances warrant.
Moreover, a revocable living trust effectively avoids probate, a court-supervised process that can be lengthy, expensive, and public. This is a significant advantage for most individuals, as they prefer to keep their financial matters private. Consequently, when the grantor passes away, the assets in the trust are distributed according to their instructions without going through probate.
It’s important to note that while the grantor enjoys considerable control over a revocable living trust during their lifetime, it becomes irrevocable upon their death. At that point, the terms of the trust dictate how the assets are distributed to the beneficiaries.
You mentioned avoiding probate. Can you elaborate on why that’s such a crucial benefit for many people?
Probate can be a time-consuming and costly process, often taking months or even years to complete. During this period, the deceased person’s assets are typically frozen, meaning their loved ones may face delays in receiving inheritances.
Furthermore, probate proceedings are public record, meaning anyone can access information about the estate, including the value of assets and the beneficiaries. This lack of privacy can be unsettling for some families.
Have you encountered any particular challenges or common misunderstandings regarding revocable living trusts in your practice?
One misconception I often encounter is that revocable living trusts are only for wealthy individuals. That’s simply not true. A revocable living trust can be beneficial for people of all income levels, as it provides peace of mind knowing that their assets will be distributed according to their wishes and their loved ones won’t face the complexities of probate.
I recall a young couple who came to me after the unexpected passing of the husband’s father. They were overwhelmed with grief and the prospect of navigating probate seemed daunting. We created a revocable living trust for them, ensuring that their assets would be smoothly transferred to their children in the event of their untimely passing.
They were incredibly grateful for the clarity and security the trust provided during such a difficult time. It allowed them to focus on healing and supporting each other rather than getting bogged down in legal complexities.
What advice would you give to someone considering establishing a revocable living trust?
My best advice is to consult with an experienced estate planning attorney like myself. We can assess your individual circumstances, goals, and concerns, and help you determine if a revocable living trust is the right solution for you.
Thank you so much for sharing your expertise with us tonight, Steve.
