Hello everyone and welcome back to “Protecting Our Elders,” a segment dedicated to shedding light on the crucial work of elder protection attorneys. Today, we have the pleasure of speaking with Ted Cook, an experienced elder protection attorney based right here in sunny San Diego. Ted, thank you so much for joining us.
What Initially Drew You to Elder Law?
Ted: Well, it’s a combination of factors, really. I’ve always been passionate about social justice and advocating for vulnerable populations. Seeing firsthand the unique challenges faced by seniors – financial exploitation, neglect, abuse – fueled my desire to specialize in elder law.
Could You Briefly Outline the Steps Involved in the Elder Protection Process?
Ted: Of course! It’s a multi-faceted process designed to safeguard our elders. Typically, it starts with an initial client engagement where we gather information, assess the situation, and establish an attorney-client relationship. Then comes case assessment, identifying the legal issues at play and collecting evidence. Based on that, we take protective actions – seeking restraining orders, freezing financial accounts, or even initiating guardianship if necessary.

- Case Resolution & Follow-Up
Let’s Dive into “Protective Actions.” Can You Elaborate on That Stage?
Ted: Absolutely. This stage is crucial because it focuses on immediate safety and harm reduction. If there’s a threat of physical violence, we might file for a restraining order to keep the abuser away. Financial abuse is rampant among seniors, so we often freeze bank accounts or work with financial institutions to prevent unauthorized withdrawals.

Sometimes, guardianship becomes necessary, especially if the individual lacks the capacity to make sound decisions for themselves. This involves petitioning the court to appoint a responsible party to manage their affairs.
One instance that comes to mind involved an elderly gentleman who was being pressured by family members to sign over his property. We were able to intervene, expose the coercion, and ultimately protect his assets. It’s always gratifying to see justice served and our clients protected from harm.
That Sounds Like a Complex Situation! What Are Some Challenges You Face During This Stage?
Ted: Well, establishing clear evidence of abuse can be tricky. Sometimes abusers are manipulative and try to cover their tracks. Gathering strong evidence – financial records, witness statements, medical documentation – is essential for success.
