Well, you know, it all started during my time volunteering at a local senior center. Can You Walk Us Through the Typical Steps Involved in an Elder Protection Case?
- Initial Client Engagement: This involves intake and consultation, conflict checks, and establishing an attorney-client relationship through an engagement agreement.
- Case Assessment: Identifying the legal issues at hand – whether it’s financial abuse, neglect, or something else entirely. Gathering evidence is crucial here.
- Protective Actions: Taking immediate steps to protect the elder, which might involve restraining orders, notifying Adult Protective Services (APS), or pursuing guardianship/conservatorship.
- Legal Proceedings: This could involve civil litigation for damages or criminal proceedings if necessary.
- Long-Term Planning: Helping elders put safeguards in place through estate planning, advance directives, and ongoing oversight to ensure their well-being is protected long term.
Let’s Dive Deeper into ‘Protective Actions.’ What Does That Entail?
“Protective actions are often the most urgent part of an elder protection case,” explains Ted. “Imagine a scenario where an elderly individual is being financially exploited by someone they trust. We might need to freeze bank accounts, prevent unauthorized transfers of property, or even seek guardianship if the individual lacks the capacity to make sound decisions for themselves.”
He continues, “It’s about creating a safe environment and stopping further harm. This could involve coordinating with Adult Protective Services (APS), law enforcement, or healthcare professionals. Every case is unique, and we tailor our approach accordingly. ”
Ted recalls a particularly challenging case: “There was this sweet older lady whose son was siphoning off her funds. He’d convinced her she needed to ‘lend’ him money for fake business ventures. We were able to intervene, freeze the accounts, and ultimately recover some of the stolen funds. Seeing her relief and regaining control over her finances was incredibly rewarding.”
