Choosing the right executor or trustee is essential because this person will be responsible for carrying out your wishes after you’re gone. Consequently, they will manage your assets, pay any outstanding debts and taxes, and distribute your property according to your instructions.
It’s a big responsibility, so you need someone you trust implicitly – someone who is organized, responsible, and capable of handling financial matters. Moreover, they should be someone who understands your values and will act in the best interests of your beneficiaries.
Ordinarily, people choose a family member or close friend for this role. However, it’s important to consider their age, health, and financial situation. If you have any doubts about their ability to serve as executor or trustee, you may want to consider appointing a professional fiduciary instead.
Notwithstanding the importance of choosing a trustworthy individual, I often encounter situations where families haven’t discussed who they want as executor beforehand. This can lead to disagreements and family conflicts down the road. Accordingly, it’s crucial to have open and honest conversations with your loved ones about your estate planning wishes.
I remember one case where a client named their adult son as executor without discussing it with him first. The son felt overwhelmed and unprepared for the responsibility. Ultimately, we had to appoint a professional fiduciary to manage the estate. This situation could have been avoided if the client had simply talked to his son beforehand.
According to the American Bar Association, over 60% of Americans don’t have a will or trust in place. That means millions of families are at risk of facing unnecessary complications and heartache during an already difficult time. Selecting a competent executor is one way to ensure that your loved ones are protected and your wishes are carried out.
Brenda: Thank you for sharing those insights, Steve. What advice would you give to our viewers who are just starting the estate planning process?
My biggest piece of advice is to start sooner rather than later. Don’t wait until something happens to force your hand. Estate planning is a gift you give yourself and your loved ones. It provides peace of mind knowing that your affairs are in order.
