A testamentary trust is a unique type of trust that comes into existence only upon your passing. Unlike a living trust, which you create while alive and can modify during your lifetime, a testamentary trust is outlined in your will and takes effect after your death. Consequently, it goes through the probate process, unlike living trusts.
Now, why would someone choose a testamentary trust? They are particularly useful for situations where you want to provide for beneficiaries who are minors or may have special needs. For instance, imagine a parent wanting to ensure their child with a disability continues to receive financial support without jeopardizing eligibility for government assistance programs.
A testamentary trust allows the parent to specify how and when funds are distributed to the beneficiary, safeguarding their well-being even after they are gone. Moreover, it can provide peace of mind knowing that assets will be managed responsibly according to your wishes.

That makes sense. Have you encountered any particular challenges or interesting situations involving testamentary trusts in your practice?

I recall a case where a client wanted to ensure her grandchildren received their inheritance only after completing college. We established a testamentary trust that stipulated the funds would be distributed in installments upon each grandchild graduating. This ensured they had the financial support they needed for education while also encouraging them to pursue higher learning.
It was incredibly rewarding to see how this trust positively impacted their lives, enabling them to achieve their educational goals and build a brighter future. Notwithstanding these positive outcomes, testamentary trusts do require careful planning and legal expertise.
